The Department of Justice was called to investigate if many of former President Joe Biden’s orders, pardons, and actions are “unconstitutional and legally void.”
Missouri Attorney General Andrew Bailey called for a probe following the bombshell report by the Heritage Foundation’s Oversight Project questioning “who controlled the autopen” during the Biden presidency. And the latest update from the group is that the “same autopen signature” was used on almost every document.
Critics were accused of spreading conspiracy theories during the Biden years, as questions about his evident cognitive decline persisted. But according to the Oversight Project findings, Biden’s autopen signature was so widespread that it begs the question of who was actually in charge.

“We gathered every document we could find with Biden’s signature over the course of his presidency. All used the same autopen signature except for the announcement that the former President was dropping out of the race last year,” the Oversight Project said in a post on X, sharing some examples of documents signed by “Joe Biden,” including two executive orders and his announcement that he was dropping out of the 2024 presidential race.
The group added more questions and information in posts on X, including an interview with Republican House Speaker Mike Johnson who recalled in an interview that Biden didn’t remember signing an order.
Recall that former President Biden admitted to @SpeakerJohnson that he did not remember signing an executive order pausing LNG exports.
So, who signed it?

“For investigators to determine whether then-President Biden actually ordered the signature of relevant legal documents, or if he even had the mental capacity to, they must first determine who controlled the autopen and what checks there were in place,” the Oversight Project noted.

“I am demanding the DOJ investigate whether President Biden’s cognitive decline allowed unelected staff to push through radical policy without his knowing approval,” AG Bailey wrote. “If true, these executive orders, pardons, and all other actions are unconstitutional and legally void.”
“Though presidents always have gatekeepers, in Biden’s case, the walls around him were higher and the controls greater, according to Democratic lawmakers, donors and aides who worked for Biden and other administrations. Staff limited Biden’s ability to speak with others and limited the sources of information he consumed,” he added.
None of the Biden pardons will likely hold up in court. People like Liz Cheney, Adam Kinzinger, & specifically Adam Schiff have a lot to be worried about. They are no longer safe from prosecution and should be prepared to face investigations and prosecutions.
