‘You get one year in jail—no early exits’: Trump double dog dares the Supremes with flag burning order

President Donald J. Trump has signed a sweeping executive order targeting individuals who burn or desecrate the American flag.

The executive order, signed in the Oval Office, directs the Department of Justice to take swift and serious action against individuals who engage in flag burning—an act the Supreme Court controversially ruled as protected free speech in its 1989 Texas v. Johnson decision. That ruling, stemming from anti-war protests in the 1960s and 70s, has long stood as a sore spot for patriotic Americans who view the flag not as a mere piece of cloth, but as the embodiment of the nation’s history, sacrifice, and values.

“If you burn a flag, you get one year in jail—no early exits, no nothing,” Trump declared from the Oval Office, reaffirming his tough-on-crime stance. His executive order not only seeks to impose a mandatory minimum sentence for flag desecration but also calls for the deportation of non-citizens involved in such acts.

In the order, the President made clear his intention to “restore respect and sanctity to the American flag” and instructed the Department of Justice to “prosecute those who incite violence or otherwise violate our laws while desecrating this symbol of our country, to the fullest extent permissible under any available authority.”

Attorney General Pam Bondi has been tasked with reviewing all recent instances of flag burning to identify any additional legal charges that can be pursued. Furthermore, the order encourages the Justice Department to actively seek legal avenues for challenging the Supreme Court’s 1989 ruling, signaling that Trump is not content with symbolic gestures—he wants legal change.

Trump’s crusade against flag desecration is nothing new. Since entering the political arena, he has consistently argued that the American flag should be afforded the highest levels of legal protection. In prior statements, he has even suggested that individuals who burn the flag should lose their citizenship, though that suggestion raises constitutional questions.

During his 2024 campaign, Trump floated the idea of a constitutional amendment to ban flag burning outright—an idea that gained traction among several Republican lawmakers and grassroots conservatives. His stance has only intensified in response to growing anti-American protests, particularly those associated with the far-left and anti-ICE movements. At a recent event at Fort Bragg, Trump lambasted radical demonstrators who burned the American flag while waving foreign ones.

“These are animals,” Trump said bluntly. “They proudly carry the flags of other countries. They don’t carry the American flag. They only burn it. Did you see a lot of the flags being burned? They weren’t being burned by people from our country, or from people who love our country. People that burn the American flag should go to jail for one year.”

The President also confirmed that his administration is working closely with lawmakers in Congress to advance federal legislation banning flag desecration. “We’ll see if we can get that done. We’re working with some of your senators,” Trump told supporters.

Though his initial signing of the executive order was reportedly delayed for undisclosed reasons, Trump’s follow-through demonstrates his resolve.

Critics on the left may claim his order infringes on free speech. But for millions of Americans who still stand for the anthem, salute the flag, and honor our veterans, President Trump’s action is a long-overdue reaffirmation that respect for America is not optional—it’s foundational.
