U.S. Attorney Jeanine Pirro is seeking an 18-month prison sentence for Emily Gabriella Sommer, the 32-year-old D.C. woman who spat on former U.S. Attorney Edward R. Martin Jr. during a live interview.
Federal authorities arrested and charged Sommer in May for allegedly spitting on Martin during a recorded interview. Pirro is pushing for an 18-month prison sentence for Sommer, according to multiple reports.
Sommer pleaded guilty in August to three counts of assaulting federal officials after spitting on Martin and attacking two Deputy U.S. Marshals during her arrest. U.S. District Judge Jia M. Cobb scheduled her sentencing for Oct. 10.
Sommer confronted Martin on May 8, 2025, while he was giving an on-camera interview outside the U.S. Attorney’s Office, according to court documents. She identified him, spat on his shoulder, and yelled, “You are a disgusting man. F— you, Ed Martin. My name is Emily Gabriella Sommer, and you are served.”
That same evening, investigators linked an X account using the handle @EmilyGabriellaS and the display name “Lefttits” to posts about the incident. Law enforcement identified the account as likely belonging to Sommer.
Deputy U.S. Marshals arrested Sommer on May 22 and during the arrest, she spat on one marshal, kicked him, and kicked a second marshal shortly afterward.
