DBS BILL BRIEF: Company bankrupt, executives collecting bonuses? Congress wants new restrictions

by

Congress churns out thousands of bills, but what’s really in them, and how could they affect you? DBS BILL BRIEF breaks down two bills a day IN PLAIN ENGLISH.

IN PLAIN ENGLISH

Imagine a company going bankrupt while its executives receive special bonuses. Workers are worried about their jobs. Creditors are wondering whether they’ll get paid. Yet some people at the top may still be collecting extra compensation.

Rep. Mary Gay Scanlon, Democrat of Pennsylvania, wants tougher restrictions on that practice.

WHAT’S IN THE BILL?

H.R. 10942, the No Bonuses in Bankruptcy Act of 2026, would amend the federal Bankruptcy Code to prohibit certain bonus payments to highly compensated employees and corporate insiders for services performed during a bankruptcy case.

The target is compensation paid to people in positions of influence when the company is already under bankruptcy protection.

That makes the question more complicated than whether executives deserve bonuses generally. Bankruptcy proceedings involve creditors, employees and competing claims on limited assets.

HERE’S THE CATCH

The proposal concerns defined compensation arrangements and categories of employees. It should not be described as abolishing every incentive payment at every financially troubled business.

Existing federal bankruptcy law already restricts certain insider retention and compensation arrangements. The new measure would seek to tighten those rules.

Another important distinction: Filing for bankruptcy does not by itself establish that a company’s executives committed fraud or violated existing compensation laws.

HAVEN’T WE HEARD THIS BEFORE?

Yes. Executive bonuses in bankruptcy have been controversial for years, particularly when companies cut jobs or cannot fully repay creditors. Congress has previously imposed restrictions, and lawmakers continue arguing over whether those protections are strong enough.

WHERE DOES IT STAND?

H.R. 10942 was introduced October 29 and referred to the House Judiciary Committee. It has not passed the House.

The bottom line: Washington is considering stricter rules for executive bonuses during bankruptcy, but the new restrictions are only a proposal.
