Actor Will Smith could be gearing up for legal action after claims that the former “Fresh Prince” star is gay and was caught having sex with a male co-star.

He also may not be filing any lawsuits at all, as it was not too clear how his wife Jada Pinkett Smith meant her comments to land when she finally spoke out about the wild accusation from a man who describes himself as Will Smith’s former personal assistant,

“We got Jada leaving iHeartRadio Wednesday morning in NYC, and asked about her thoughts surrounding the allegation Will was caught having sex with another man — her response? ‘We Suin’!'” TMZ reported Wednesday. “It doesn’t seem Jada’s joking … and a source close to the situation told us Will is actually weighing his legal options, so there could be some truth to Jada’s response.”

Smith has denied the claims made by Brother Bilaal that he had walked in on Smith engaged in sex with fellow actor Duane Martin in a dressing room and a representative for the 55-year-old actor told TMZ, “This story is completely fabricated and the claim is unequivocally false.”

“It’s ridiculous, right? And it’s nonsense,” Smith’s estranged wife told The Breakfast Club radio show on Wednesday.

“This is a person who tried to do a shakedown, a money shakedown that didn’t work. We’re going to take legal action. Because it’s one thing to have your opinion about somebody versus just making up salacious, malicious stories. So that’s actionable, so we’re going to roll with that,” she said.

“So for me, unfortunately, it’s part of it,’ she added. ‘It’s not true, we’re going to take care of it. And that’s that,” she added.

“It’s based around this person’s idea that they in some way were doing business around Will’s book and that they spent money or what have you and they need to be compensated,” Jada explained.

“So he already tried to do that money shakedown,” she said. “Will was willing to give him a certain amount or what have you and he didn’t take it so this whole situation is based on that.”

Brother Bilaal had made the claims and insulted Smith’s manhood in an interview with internet personality Tasha K, where he compared the “Men in Black” star’s penis to the size of a “pinky toe” as he promoted his forthcoming book, “Will Smith Demonic Circle.”

“I opened the door to Duane’s dressing room and that’s when I see Duane having anal sex with Will,” Brother Bilaal claimed in the now-viral video of the interview. “There was a couch and Will was bent over on the couch and Duane was standing up killing him, murdering him – it was murder in there.”

Whether or not they do decide to pursue legal action, Jada did note how her husband handles difficult situations such as this.

“Here’s one good thing about Will – Will’s always going to find the funny,” she told The Breakfast Club. “He’s always going to find the funny.”
