For years, the most explosive allegation surrounding Rep. Ilhan Omar has centered on one man: Ahmed Nur Said Elmi, the British citizen she married in 2009 and whom critics have alleged is her brother.
But if federal investigators are looking for something that could actually threaten Omar’s U.S. citizenship, immigration officials say they may need to look somewhere else.
Sources familiar with immigration law told the New York Post that even if investigators established that Omar entered a sham marriage, that alone would not provide grounds to deport a U.S. citizen. The Post also reported that the statute of limitations for a criminal marriage-fraud prosecution tied to that marriage has expired.
Instead, officials pointed to the circumstances under which Omar became an American citizen.
Omar has said she obtained citizenship in 2000 while still a minor through her father, Nur Said Mohamed, who had become a naturalized U.S. citizen.
A former immigration official told the Post that if investigators could prove Omar or her father made material misrepresentations during the immigration or naturalization process, the government could potentially pursue denaturalization.
That distinction matters now because there really is a federal investigation underway.
White House border czar Tom Homan confirmed Sunday that Homeland Security Investigations is examining allegations involving Omar, although he declined to reveal what investigators have found or precisely what they are investigating.

“I know things are going on, but I can’t give specifics of what’s happening,” Homan told Fox News.
Homan said that if investigators uncover immigration or marriage fraud, “no one’s above the law,” adding that HSI would continue its investigation.
Omar has repeatedly denied the longstanding allegation that Elmi is her brother. That claim has circulated for years but has not been established publicly through court findings or conclusive documentary evidence.

The Post’s sources say investigators could instead scrutinize Omar’s age when she obtained citizenship, along with information contained in her family’s immigration paperwork.
After years of everyone staring at the alleged brother, the federal government may be staring at Dad’s paperwork.
That would be quite the plot twist.
