Prosecutors make charging decision after Florida man admitted to years of having sex with his mother

by

BS BULLETIN:

  • A 22-year-old Florida man and his 46-year-old mother were arrested after deputies uncovered what authorities described as a years-long incestuous relationship.
  • Prosecutors later filed an incest charge against the mother but declined to pursue the same charge against her son.
  • The State Attorney’s Office has not publicly explained the differing charging decisions.

A Florida man who admitted to having an incestuous relationship with his mother over several years will not be prosecuted, even though his mother is facing a felony charge in the same case.

Shane Clemens, 22, and his mother, Christina Clemens, 46, were arrested after Polk County deputies responded to a domestic dispute at their Lakeland-area home, according to arrest records reviewed by The Smoking Gun.

Authorities said the investigation began after Shane told deputies that he wanted the sexual relationship with his mother to stop.

According to the arrest report, Shane told investigators that he had not grown up with Christina but reestablished contact with her after he turned 18. Police said the relationship later became sexual and continued for several years.

Christina also allegedly acknowledged the relationship during a recorded interview with investigators, according to the report. Authorities said the encounters occurred repeatedly between 2023 and 2026. Both were initially arrested on felony incest charges.

But prosecutors ultimately treated the two cases differently.

A Sept. 16 felony information charged Christina with incest, alleging that she unlawfully had sexual intercourse with her son between September 2023 and August 2026. Under Florida law, the charge is a third-degree felony that can carry up to five years in prison.

Shane, however, was released from the Polk County jail the following day.

Jail records cited by The Smoking Gun list the disposition of his case as “No Billed,” indicating that prosecutors decided not to pursue a criminal charge against him. The reason for that decision has not been made public.

The Smoking Gun reported that a spokesperson for the State Attorney’s Office had not responded to questions seeking an explanation for why prosecutors charged Christina but declined to prosecute Shane.

Christina remained jailed on a $5,000 bond ahead of an Oct. 6 arraignment, according to the report.
