WASHINGTON — Rep. James Clyburn abruptly withdrew his support for expanding the Supreme Court to 13 justices Sunday after an aide reportedly explained how Supreme Court nominations work.
Clyburn had enthusiastically endorsed adding four seats during an appearance on NBC’s “Meet the Press.”
“Thirteen is a pretty good number,” Clyburn said. “A baker’s dozen would be a good number to have on the court.”
The proposal remained Democratic policy for approximately seven minutes.
According to congressional aide Justin Case, Clyburn was celebrating the prospect of four new Supreme Court justices when a staff member cautiously raised his hand.
“He asked who gets to choose them,” Case said. “That’s when the room got very quiet.”
Staffers then explained that Supreme Court vacancies are filled when the president nominates someone and the Senate confirms the nominee.
Clyburn reportedly stared silently at the wall for several seconds.
“You mean Trump?” he finally asked.
The meeting was immediately adjourned.
Within minutes, Clyburn’s office released a revised court-reform proposal calling for 13 Supreme Court justices beginning January 20, 2029.
“After further study, the congressman has concluded that nine is actually a beautiful and historically significant number,” Case said. “At least for the next couple of years.”
Asked whether Democrats would still support 13 justices if a Democrat wins the White House in 2028, Case declined to speculate.
He then winked for an unusually long time.
